- Service Authorization
- The formal written or digital agreement signed by the property owner, authorized commercial manager, or insurance policyholder, empowering our 24/7 restoration response team to assess and secure the property.
- Processor
- The third-party payment gateway, explicitly Stripe, Inc., utilized for processing secure electronic transactions and credit card payments.
2. Acceptable Use & Intellectual Property
By accessing our site, requesting a damage assessment, or utilizing our documentation portal, you agree to adhere to our Acceptable Use policy. Users may not use the site or our physical site reports for unlawful purposes, automated data scraping, or unauthorized access to other property owners' restoration records.
All methodologies, branding, digital reports, and documentation processes — including split-screen moisture comparisons and site schematics — are the intellectual property of Emergency Mitigation Services LLC and are provided strictly for the affected property owner and their active insurance claim adjustments.
3. Payment Processing & Fees
We are focused exclusively on the mitigation phase and utilize secure billing practices. Payment credentials are processed directly by our secure third-party processor (Stripe, Inc.) for all credit card and electronic transactions. Emergency Mitigation Services LLC does not store your raw payment information on our servers.
- Customer authorization is required at the time of checkout or upon approval of the written estimate.
- Services are provided strictly on a per-incident or project-based emergency basis — no recurring subscriptions apply.
- You agree to provide current, complete, and accurate purchase and account information for all emergency interventions requested.
4. Refund & Dispute Policy
Because our work involves rapid, immediate-deployment protective systems — such as polyethylene shrink wrap systems and emergency board-up installations — mitigation services are billed per event or strictly as defined in the signed service authorization.
In the event of a payment discrepancy, the dispute flow follows the standard protocol set by Stripe, Inc. or is handled in alignment with your insurance carrier's adjustment process. Claims regarding workmanship or the 30-day warranty on tarp systems must be reported immediately for assessment and rectification.
5. Liability & Limitations
Our priority is safety first and the preservation of property. While Emergency Mitigation Services LLC provides immediate professional roof protection after storms to prevent further damage, we act as the first line of defense — not the permanent repair contractor. We are not liable for pre-existing structural instability, prior interior water damage, or secondary delays caused by third-party insurance carrier evaluations.
6. Governing Law
These terms, our professional agreements for emergency tarp installation, and any separate service authorizations shall be governed by and construed in accordance with the laws of the State of Florida, USA. You irrevocably submit to the exclusive jurisdiction of the Orange County Courts for any disputes arising from these services.
